We may update our website as required and may change the content at any time. While we aim to ensure that the content on our site is accurate and up to date, sometimes our website may be behind. If you see anything on our website that is inaccurate or outdated, please contact us for clarification.
3. Accessing Our Website
The website and its content are delivered on an "as-is" and "as available" basis. TicketMicket disclaims all warranties, express or implied, including any implied warranties of merchantability and fitness for a particular purpose. While we endeavor to ensure that the website is fully operational at all times, there may be occasions when there are interruptions to service due to essential maintenance, system upgrades, internet service interruptions, or other factors beyond our control. TicketMicket will not be liable to you for any reason should our website become unavailable at any time for any period.
4. Intellectual Property Rights
We are the owner or the licensee of all intellectual property rights in our site and in the material published on it. Unless expressly authorized by TicketMicket, you must not modify, rent, lease, loan, sell, distribute, or create derivative works based on our website, brand, or services for performance, service analysis, or competition. Our status (and that of any authorized contributors) as authors of the content on the website must always be acknowledged.
5. Canceled, Varied, or Postponed Events
The event organizer is responsible and liable for providing any refund or comparable ticket in cases where an event is canceled, varied, or postponed. Please check the terms of sale of the event organizer to determine their policy on canceled, varied, or postponed events. So that the event organizer can contact you with information relating to your tickets or the event, we may be required to pass on your contact information. We do not authorize the event organizer to send you any unsolicited emails, mail, or “spam.” We and the event organizer will use reasonable endeavors to notify ticket holders of a cancellation, variation, or postponement; however, the responsibility to ascertain whether an event has been canceled, varied, or postponed is yours. We do our best to inform you as soon as we can when an event is canceled. We cannot guarantee that the ticket holders will be informed of a cancelation, variation, or postponement before the date of the event.
6. Exchanges and Refunds
All ticket sales are final. For clarification, you are not entitled to a refund if: If your ticket is lost, stolen, or damaged (including if it is lost in the mail), we are not required to replace it unless we can identify the seat corresponding to the ticket or, in the case of a general admission ticket, can identify and cancel the relevant ticket. We may charge a reasonable administration fee in these circumstances. Service Fee and Facility Fee are not refundable.
7. Content
Although we make reasonable efforts to update the information on our site, we make no representations, warranties, or guarantees, whether express or implied, that the content on our site is accurate, complete, or up to date. All event content, which may include information such as event name, date, time, venue, ticket prices, ticket availability, images, event description, and headline acts, is uploaded to our website by the event organizer. Accuracy of this content is the responsibility of the event organizer, and TicketMicket is not liable for any errors or inaccuracies in this content.
8. Limitation of Liability
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
• use of or inability to use our site; or
• use of or reliance on any content displayed on our site.
If you are a business user, please note that in particular, we will not be liable for:
• loss of profits, sales, business, or revenue;
• business interruption;
• loss of anticipated savings;
• loss of business opportunity, goodwill, or reputation; or
• any indirect or consequential loss or damage.
If you are a customer, please note that we are not liable for the products or services listed on our website by event organizers or their failure to deliver the purchased product or service. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of our site or your downloading of any content on it or on any website linked to it.
9. Third-Party Links and Resources on Our Website
Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources. We assume no responsibility for the content of websites linked on our website. Each of the parties hereto irrevocably submits to the exclusive jurisdiction of the courts of the State of California and the United States District Court in California for the purpose of any action or judgment relating to or arising out of this Agreement or any of the transactions contemplated hereby and to the lay of venue in such court.
